COLUMBIA, S.C. — A South Carolina jury has awarded $10 million to the husband of a woman who died of cancer after miscommunication between her doctors resulted in surgical delays a lawsuit says would have saved her life.
The State newspaper reports Saturday that the award against Dr. Philip Kinder and Columbia Urological Associates came after Joann Bannister’s widowed husband rejected an offer of $250,000 to settle the case.
Joann Bannister died in October 2012 at age 70. Attorneys for her family say her doctors for more than a year ignored recommendations from radiologists to further evaluate and remove a growth on Bannister’s kidney.
Kinder’s attorneys have filed a motion to overturn or reduce the verdict.
