Couple awarded $800,000 verdict

A Washington County jury recently awarded a Seymour couple $800,284.24 in a civil lawsuit filed in Washington Circuit Court.

Mark and Diane King were awarded that amount to be paid by their insurer, All American Insurance Co., after a weeklong jury trial that ended March 2.

The lawsuit was filed on behalf of the Kings on Oct. 22, 2013, by Seymour attorney Roger Pardieck. Attorney Matt Schad of New Albany served as co-counsel.

The lawsuit stemmed from a wreck Dec. 21, 2012, which occurred as a vehicle driven by Mark King was involved in a wreck with Daniel Elkins of Vallonia on State Road 135 in Washington County. The wreck, which left Mark King injured, occurred after Elkins lost control of his vehicle and hit King, according to court records.

Washington Circuit Court Judge Larry W. Medlock reduced the amount of the verdict by $125,000, which had already been paid to Mark King by AAA Insurance Co. and Geneva Insurance Co. on behalf of Elkins, and $10,000 paid by All American Insurance as medical pay benefits for Mark King.

Pardieck said he was satisfied the outcome was beneficial to his clients.

“We appreciate the jury’s understanding of the extent of Mr. King’s injuries and are very pleased by this outcome for both Mr. and Mrs. King,” he said. “They’re both deserving and just very fine people.”
