Authorities still investigating murder

Authorities on Tuesday continued to investigate Sunday’s murder in a grocery store parking lot on the city’s west side.

William E. Baker, 61, of Seymour has been held on murder charges after police said he shot his brother-in-law, Dustin Payne, 33, of Scipio, once in the chest during a family dispute in the parking lot of JayC Food Store, 1181 W. Tipton St.

The shooting was reported to Seymour police at 5:57 p.m.

“The investigation is ongoing,” Jackson County Prosecutor Jeff Chalfant said.

Police have not filed a probable cause affidavit with the court. Affidavits are completed by investigators prior to an official case filing and provide a basis for charges along with other investigative material, including interviews with witnesses and others.

Chalfant did not give a timeline on when the court document may be filed.

The only update police have made on the case since late Sunday is that Baker shot Payne with a .357 handgun.

Payne was exchanging his children with his ex-wife when the incident occurred. Four children were present during the shooting.

Baker, who had arrived separately and was not involved with the exchange, and Payne began a verbal altercation, which escalated, police said.

Police are unsure how long the altercation took place before Baker shot Payne. Baker was arrested at the scene.

Payne was taken to Schneck Medical Center in Seymour before being airlifted to University of Louisville Hospital in critical condition, but he later died.

Abbott said seven witnesses were interviewed following the incident with each being either current or former family members.

Baker is being held without bond pending his initial hearing.
