A report of a stolen vehicle Wednesday morning in Seymour led to the arrest of a man on felony charges of dealing methamphetamine more than 10 grams and dealing in marijuana, police said.

The arrest of Derek Austin, 29, of Seymour occurred after Seymour police received a call from a woman reporting her 2005 Ford Explorer had been stolen, according to the probable cause affidavit signed by Officer Benjamin Miller.

The woman told police she believed Austin was the person who took the vehicle, although she also said her husband was in the vehicle, which meant it was not considered stolen by police.

Miller and Officer Kevin Settle later found the vehicle outside of a motel in the 300 block of Tanger Boulevard on city’s far east side.

While investigating, Miller said he heard male and female voices coming from a room where they suspected Austin to be staying.

Miller also reported seeing Austin and the complainant’s husband exit the room, and that’s when he approached Austin, who was carrying several items.

Austin told Miller he was throwing away his trash and left the building.

According to the report, Austin bumped into a wall and dropped the items in his hands.

Miller reported finding a glass paraphernalia pipe with a rubber hose connected to it, but Austin claimed the pipe was not his and he had found it.

Miller said he also saw Austin with a lockbox and two jars, one of which contained a white, powdery substance and the other containing two crystal-like substances.

Austin was arrested at that time, while the complaint’s husband also was detained shortly, Miller said.

Miller said he also went back to the room to look for the woman, whose voice he had heard earlier.

Miller said he talked to that women, later identified as Amanda Mikel, 26 of Seymour, and found she was wanted on a warrant for a probation violation. She also was arrested for visiting a common nuisance, a Class B misdemeanor.

During the investigation, police reported finding 71.8 grams of methamphetamine on Austin or in his motel room. The search of the Ford Explorer did not turn up any drugs or paraphernalia.

Miller said Austin told investigators the crystal-like substance in the jar was fruit preservative. The contents of that jar also were tested and determined to be methamphetamine, police said. The white powder substance in the other jar also tested positive as methamphetamine.

During a search of the room, police reported finding digital scales, a plastic bag containing what they believed to be methamphetamine, two plastic bags containing approximately 24.7 grams of marijuana and a second glass paraphernalia pipe. The lockbox contained $599, which was sorted in a manner Miller reported was consistent with the dealing of illegal narcotics.

Austin was charged with a Level 2 felony for dealing methamphetamine more than 10 grams and two Level 6 felonies for dealing in marijuana with a prior conviction and maintaining a common nuisance. He also was charged with misdemeanors for possession of paraphernalia and possession of a controlled substance.

The husband of the complainant was charged with visiting a common nuisance and released later that morning, police said.

A Level 2 felony carries a sentence ranging from 10 to 30 years with an advisory sentencing of 17½ years.
