Request Release Of Funds

On or about June 25, 2008, the City of Seymour will submit a request to the Indiana Housing and Community Development Authority (IHCDA) for the release of Community Development Block Grant funds under Title I of the Housing and Community Development Act of 1974, as amended, to undertake a project known as:

Project title: Seymour Homeowner Repair and Improvement Program

Purpose/Scope of project: Minor rehabilitation of owner-occupied housing units located within the city limits of Seymour, Indiana.

Estimated funding: $275,000

Project location if applicable: Scattered sites within the City of Seymour

The activities proposed are categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act requirements. An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at Seymour City Hall, 301-309 N. Chestnut St., Seymour, IN 47274 where the ERR can be examined or copied weekdays 8:00 A.M. to 4:00 P.M.

Public Comments

Any individual, group, or agency may submit written comments on the ERR to the City of Seymour, 301-309 N. Chestnut St., Seymour, IN 47274. All comments received by June 24, 2008 will be considered by the City of Seymour prior to authorizing submission of a request for release of funds.

Release of Funds

The City of Seymour certifies to IHCDA that Craig Luedeman in his capacity as Mayor, City of Seymour consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. IHCDA's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the City of Seymour to use Program funds.

Objections to Release of Funds

IHCDA will accept objections to its release of funds and the City of Seymour's certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Seymour; (b) the City of Seymour has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the City of Seymour has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by IHCDA; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to IHCDA, 30 South Meridian Street, Suite 1000, Indianapolis, IN 46204. Potential objections should contact IHCDA to verify the actual last day of the objection period.
