An ordinance amending chapter 75 of the Seymour City Code concerning regulation of parking

Be it ordained by the Common Council of the City of Seymour, Indiana.

Section 1. Schedule I (A) of Chapter 75 of the Seymour City Code is hereby amended to designate the following location as a prohibited area for the parking of motor vehicles within the city:

The north side of Brown Street between Poplar Street and Lynn Street.

Section 2 Schedule II (D) of Chapter 75 of the Seymour City Code is hereby ADDED to designate the following location as an area restricted to two-hour parking of motor vehicles within the city:

(D) Two-hour parking. On all days except Saturdays and Sundays, it shall be unlawful for any person to park, or permit to remain standing, any motor vehicle in the same place, for more than two (2) hours, on any portion of the following areas, between the hours of 6:00 a.m. and 6 p.m.:

The north side and the south side of Brown Street between Walnut Street and Poplar Street.

Section 3. All prior ordinances or parts thereof inconsistent with any provisions of this ordinance are hereby repealed.

§10.99 of the Seymour City Code provides in relevant part that "Any person violating any of the provisions of this code shall be guilty of a code violation...(and) shall, upon conviction, be subject to a fine not exceeding $2,500." Fines can increase for each repeat offense. Offenders can also be assessed attorney fees, court costs and expenses incurred by the City for prosecuting violations of the Seymour City Code.

The Clerk-Treasurer shall have this ordinance published one time each week for two (2) consecutive weeks in the Seymour Tribune.

This ordinance shall be in full force and effect from and after its passage, approval by the Mayor, and publication, all as by law provided.

ADOPTED by the Common Council and Approved by me, as Mayor, this 25th day of August 2008, at 7:40 p.m.
