The Plan Commission of the City of Seymour, Indiana will hold a public hearing on the 8th day of May, 2008, at 7:00 p.m. at City Hall, 301-309 N. Chestnut Street, Seymour, Indiana on a "Petition to Rezone Real Estate" within the jurisdiction of the Plan Commission. A copy of the petition is on file and available for review at the Department of Planning & Zoning of the City of Seymour, Indiana.

The hearing is open to the public, all adjoining property owners, and any other interested persons. Interested persons may appear and offer comments on the petition during the hearing. Any person who chooses to submit written comments or objections may do so at the Department of Planning & Zoning, 301-309 N. Chestnut Street, Seymour Indiana before 4:00 p.m. on the day of the hearing.

The name of the applicant is Skaggs Builders and the owner is The First Church of the Nazarene. The affected real estate is 311 Holiday Square Road and fronts on W. Tipton Street. The present zoning classification is C-3 which is Commercial Business and the requested zoning classification is R-3, Multi-Family.

The applicant has requested a rezone for the real estate to construct quality, all brick, low maintenance on the property.

The legal description of the real estate affected is as follows: Seymour First Church of the Nazarene Inc. The land referred to in this Commitment is situated in the State of, County of Jackson and is described as follows: A part of the Southwest Quarter of Section fifteen (15), Township Six (6) North, Range Six (6) East and a part of the Southeast Quarter of Section Sixteen (16), Township Six (6) North, Range Six (6) East, Jackson County, Indiana, more particularly described as follows: Commencing at the Northeast corner of the Southeast Quarter of said Section Sixteen; thence along the North line of said quarter section South 89 degrees 52 minutes 45 seconds West (an assumed bearing) 233.15 feet; thence South 00 degrees 32 minutes 00 seconds East 657.04 feet; thence East 50.00 feet to the point of beginning of this description; thence continuing East 572.47 feet to the approximate centerline of a drainage ditch; thence along the approximate centerline of said ditch South 02 degrees 04 minutes 32 seconds East 162.48 feet; thence south 88 degrees 19 minutes 10 seconds West 576.82 feet; thence North 00 degrees 32 minutes 00 seconds West 179.37 feet to the point of beginning, containing 2.254 acres, more or less.

This notice is provided pursuant to Title 5 and 36 of the Indiana Code and Section 10 of the Municipal Code of the City of Seymour, Indiana.
