The Board of Zoning Appeals of the City of Seymour, Indiana will hold a public hearing on May 27, 2008, at 7:00 p.m. at City Hall, 301-309 N. Chestnut Street, Seymour, Indiana on a "Petition to Vary from Land Use Requirements" for real estate within the jurisdiction of the Board of Zoning Appeals. A copy of the petition is on file and available for review at the Department of Planning and Zoning of the City of Seymour, Indiana.

The hearing is open to the public, all adjoining property owners, and any other interested person. Interested persons may appear and offer comments on the petition during the hearing. Any person who chooses to submit written comments or objections may do so at the Department of Planning and Zoning, 301-309 N. Chestnut Street, Seymour, Indiana before 4:00 p.m. on the day of the hearing.

The name of the applicant is Jackson County Schneck Memorial Hospital d/b/a Schneck Medical Center and the owner is Jackson County Schneck Memorial Hospital d/b/a Schneck Medical Center. The affected real estate addresses are 401, 405, 411, 415 and 417 South Poplar Street and 417 West Brown Street, Seymour, Indiana and front on Poplar and Brown Streets. The present zoning classification is R-1 which is Residential.

The applicant has requested a variance on land use requirements for the real estate to allow the real estate to be used as parking to replace parking lost due to hospital expansion.

The legal descriptions of the real estate affected are as follows:

(a) 405 South Poplar - part of Lot 10 Block A of Butler's Addition to the City of Seymour;

(b) 405 South Poplar - Lot 9 Block A of Butlers Addition to the City of Seymour;

(c) 411 South Poplar - Lot 8 Block A of Butlers Addition to the City of Seymour;

(d) 415 South Poplar - Lot 7 Block A of Butlers Addition to the City of Seymour;

(e) 417 South Poplar - Lot 6 Block A of Butlers Addition to the City of Seymour;

(f) 417 West Brown - part of Lot 10 Block A of Butler's Addition to the City of Seymour.

This notice is provided pursuant to Titles 5 and 36 of the Indiana Code and the Municipal Code of the City of Seymour, Indiana.
