To the owners of the within described real estate and all interested parties:
By virtue of a certified copy of a decree to me directed from the Clerk of the Superior Court of Jackson County, Indiana, in Cause No. 36D01-0902-MF-13, wherein National City Mortgage, a Division of National City Bank was plaintiff and Dave L. Salesman, et. al., were the defendants, requiring me to make the sum as provided for in said Decree with interest and costs, I will expose at public sale to the highest bidder, on the 3rd day of December, 2009, at the hour of 10:00 a.m. or as soon thereafter as is possible, at 150 East State Road 250, Brownstown, IN 47220, the fee simple of the whole body of real estate in Jackson County, Indiana:
A part of the Northwest Quarter of the Southwest Quarter of Section Sixteen (16), Township Six (6) North, Range Six (6) East, bounded as follows: Beginning at a point 573.46 feet North of a point in the center of U.S. Highway No. 31, which point is the Southwest Corner of a tract of 27 acres by parallel lines off the East side of the Northwest Quarter of the Southwest Quarter of Section 16, and running thence East parallel with U.S. Highway No. 31 a distance of 370 feet to the West line of a 30 foot roadway; thence North along said roadway 58.86 feet; thence West 370 feet; thence South 58.86 feet to the place of beginning, containing one-half (1/2) acre, more or less.
Also, the right to use in common with other owners of tracts in said 27 acre tract as a roadway a strip of ground 30 feet in width, East and West, lying East of the above described tract and running from the North line of said tract South 196.72 feet; thence turning East upon a strip of ground 20 feet in with, North and South, and running East to the gravel road along the East line of said 27 acre tract. Also the right to use as such roadway a strip of ground 300 feet in with, East and West, its West line being 500 feet East of the West line of said 27 acre tract and running from said East and West 20 foot roadway South to U.S. Highway No. 31.
