The Plan Commission of the City of Seymour, Indiana will hold a public hearing on the 8th day of May, 2008 at 7:00 p.m. at City Hall, 301-309 N. Chestnut Street, Seymour, Indiana on a "Petition to Rezone Real Estate" within the jurisdiction of the Plan Commission. A copy of the petition is on file and available for review at the Department of Planning & Zoning of the City of Seymour, Indiana.
The hearing is open to the public, all adjoining property owners, and any other interested person. Interested persons may appear and offer comments on the petition during the hearing. Any person who chooses to submit written comments or objections may do so at the Department of Planning & Zoning, 301-309 N. Chestnut Street, Seymour, Indiana before 4:00 p.m. on the day of the hearing.
The name of the applicant is Richard Temple and the owner is the same. The affected real estate is 5.93 acres located on the north and north east side of Colonial Drive and the 2.01 acres located to the south of Colonial Drive, along Airport Road. The present zoning classification is R-1 which is Single Family Residential and the requested zoning classification is C-2, General Business.
The applicant has requested a rezone for the real estate to convert the property back its previous zoning which is the best use of the property.
The legal description of the real estate affected is as follows: A part of the Southwest quarter of the Southwest quarter of Section Nineteen (19), Township 6 North, Range 6 East, described as follows: Beginning at a point that is 49.6 feet East of an 8"x8" monument then 1100 ft. North and East 426 ft. to the point of the beginning, thence South 193.15 ft.; thence East 327 ft.; thence North 193.15 ft.; thence West 327 ft. to the place of beginning containing 1.4496 acres.
Also: A part of the Southwest quarter of the Southwest quarter of Section nineteen (19), Township Six (6) North, Range Six (6) East, described as follows: Beginning at a point that is 49.6 feet East of an 8"x8" monument then 1100 ft. North and thence East 1100 ft. to the point of the beginning; thence South 417.15 ft.; thence West 307 ft.; thence North 285 ft.; thence West 200 ft.; thence North 132.15; thence East 507 ft. to the Place of beginning containing 3.547 acres.
The total of these two sections of real estate is 4.9966 acres.
Also A part of the Southwest quarter of the Southwest quarter of Section 19, Township 6 North, Range 6 East, of the Second Principal Meridian, beginning at a point 550 feet North of an 8"x8" Concrete Monument, located 49.6 feet East of the Southwest corner of Section 19; thence East 295 feet; thence North 296.85; thence West 295 feet; thence South 296.85 feet to the Place of beginning containing 2.0104 acres.
Also A part of the Southwest quarter of the southwest quarter of Section 19, Township 6 North, Range 6 East, described as follows: Beginning at a point 1100 feet north of and 49.6 feet east of the southwest corner of said section; thence east 131 feet to the Point of the Beginning; thence South 186 feet; thence West 131 feet; thence South 7.15 feet; thence East 226 feet; thence North 193.15 feet; thence West 95 feet to the place of the beginning. Containing .4427 acres. Grantors also hereby convey an easement/right of way to the street know as Colonial Drive across the South side of the above described property.
