The Board of Zoning Appeals of the City of Seymour, Indiana will hold public Hearings on the 12th day of July, 2012 and the 24th day of July, 2012 at 7:00 p.m. at City Hall, 301-309 N. Chestnut Street, Seymour, Indiana on a Petition to Vary from Land Use Requirements” for real estate within the jurisdiction of the Board of Zoning Appeals. A copy of the petition is on file and available for review at the Department of Planning & Zoning of the City of Seymour, Indiana.
The hearing is open to the public, all adjoining property owners, and any other interested person. Interested persons may appear and offer comments on the petition during the hearing. Any person who chooses to submit written comments or objections may do so at the Department of Planning & Zoning, 301-309 N. Chestnut Street, Seymour, Indiana before 4:00 p.m. on the day of the hearing.
The name of the applicant is Land Holding, LLC and the owner is same. The affected real estate is 400 S. Jackson Park Drive and fronts on S. Jackson Park Drive. The present zoning classification is C-5, Commerical Industrial. The requested zoning classification is R-2, Multi-Family Residential.
The applicant has a variance on land use requirement for the real estate to make zoning consistent with the current use as an apartment building.

A part of the Northeast quarter of the Southeast quarter of Section 17, Township 6 North, range 6 East, Jackson County, Indiana described as follows:
Commencing at the Southwest corner of the Northeast quarter of the Southeast quarter of Section 17; thence on the quarter quarter section line, East (an assumed bearing) 721.00 feet; thence North 00 degrees 00 minutes East; 335.00 feet to the true point of beginning; thence continuing North 00 degrees 00 minutes East; 150.00 feet; thence North 90 degrees 00 minutes East, 150.00 feet; thence South 00 degrees 00 minutes West, 150.00 feet; thence South 99 degrees 00 minutes West, 150.00 feet to the point of beginning.
Tract II:
A part of the Northeast quarter of the Southeast quarter of Section 17, Township 6 North, range 6 East, Jackson County, Indiana described as follows:
Commencing at the Southeast corner of the Northeast quarter of the Southeast quarter of Section 17; thence West, an assumed bearing, on the center-line of U.S. Highway number 50 and on the quarter-quarter section line 456.93 feet; thence North 410.00 feet to the true point of beginning; thence North 75.00 feet; thence North 36 degrees 58 minutes East, 133.86 feet to the westerly line of Jackson Park Drive; thence along the arc of a 318.10 foot radius curve to the right a true arc distance of 114.45 feet (a chord connecting said arc bears South 42 degrees 43 minutes 30 seconds East, and is 133.84 feet in length); thence South 77 degrees 06 minutes West, 107.00 feet; thence South 45 degrees 11 minutes 59 seconds West, 37.88 feet thence West 90.00 feet to the point of beginning.

A part of the Northeast quarter of the Southeast quarter of Section 17, Township 6 North, range 6 East, Jackson County, Indiana described as follows:
Commencing at the Southeast corner of the Northeast quarter of the Southeast quarter of Section 17; thence West, an assumed bearing, on the center-line of U.S. Highway number 50 and on the quarter-quarter section line 456.93 feet; thence North 335.00 feet to the true point of beginning; thence North 75.0 feet; thence North 90 degrees 00 minutes East 90.00 feet; thence North 45 degrees 11 minutes 59 seconds East 37.88 feet; thence North 77 degrees 06 minutes 00 seconds East 107.00 feet o the westerly right-of-way line of Jackson Park Drive; thence along the arc of a 318.10 foot radius curve to the right a true arc distance of 135.00 feet; (a chord connecting said arc bears South 20 degrees 15 minutes 30 seconds East, and is 133.98 feet in length); thence North 90 degrees 00 minutes 00 seconds West 267.64 feet to the point of beginning.
