Notice of Suit

To the defendants above named, and any other person who may be concerned.

You are notified that you have been sued in the Court above named.

The nature of the suit against you is the foreclosure of a mortgage upon the property legally described as follows:

Beginning at a point 144 feet South 4 degrees 00 minutes East of a stone at the Southeast Corner of the Northwest Quarter of Section 20, Township 6 North, Range 6 East, Jackson County, Indiana, said point of beginning being the Northeast Corner of Lot Number 4; thence South 86 degrees 00 minutes West for a distance of 201.4 feet to the Northwest Corner of Lot and also a point on the East right of way line of the Penn R.R; thence South 26 degrees 30 minutes East R/W line for a distance of 58.44 feet to the Southwest corner of Lot; thence North 86 degrees 00 minutes East for a distance of 179 feet to the southeast Corner of Lot; thence North 4 degrees 00 minutes West a distance of 54 feet to the point of beginning all lying within the Northeast Quarter of the Southwest Quarter of Section 20, TAN, RE and containing 236/1000 acre, more or less.

Commonly known as: 820 South O’Brien Street, Seymour, IN 47274-2436.

This summons by publication is specifically directed to the following defendant(s) whose whereabouts are unknown with their last known address as follows: Barthena Diane Wienhorst, 820 South O’Brien Street, Seymour, IN 47274-2436.

In addition to the above-named defendants being served by this summons, there may be other defendants who have an interest in this lawsuit.

An answer or other appropriate response in writing to the Complaint must be filed either by you or your attorney with the Clerk of the Court for Jackson County at: Clerk of Jackson County, 1420 Corporate Way, Seymour, IN 47274, on or before the 1st day of Sept. 2012, (the same being thirty (30) days after the Third Notice of Suit), and if you fail to do so a judgment may be entered against you for what the plaintiff has demanded.
